In addition, when you use any current or future Free Conference Service services whether or not included in our Website, you will also be subject to our current Terms of Use.

Your Account
You are responsible for maintaining the confidentiality of your account number and password and for restricting access to your account number and password. You agree to accept responsibility and liability for all activities that occur under your account or password whether lawful or unlawful. You are also solely responsible for all uses of your account and password, whether or not actually or expressly authorized by you. Use of conference recording capabilities and other Service functionality may subject you to State or Federal laws or regulations (such as a requirement to notify participants that a conference is being recorded). You are solely responsible for compliance with any such laws or regulations, including but not limited to providing any required notification to participants. We do not sell products or services for children. If you are under 18, you may use our services only with involvement of a parent or guardian. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion. Violation of Terms of Use may result in immediate deletion of your account.


Disclaimer of Warranties and Liability
UNLESS WE OTHERWISE AGREE IN WRITING, THIS SITE AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. UNDER NO CIRCUMSTANCES SHALL FREE CONFERENCE SERVICE BE LIABLE FOR ANY ASSUMED OR REAL LOST PROFITS OR ANY OTHER CONSEQUENTIAL DAMAGES BY CLIENT TO HAVE RESULTED FROM THE INSTALLATION OR USE OF ANY FREE CONFERENCE SERVICE EQUIPMENT OR PROGRAM MATERIAL.

EXCEPT AS EXPRESSLY INDICATED HEREIN, NEITHER PARTY MAKES ANY EXPRESS OR IMPLIED WARRANTIES, CONDITIONS OR REPRESENTATIONS TO THE OTHER PARTY WITH RESPECT TO THE SOFTWARE PRODUCT OR THE SERVICES PROVIDED HEREUNDER OR OTHERWISE, WHETHER ORAL OR WRITTEN, EXPRESSED, IMPLIED OR STATUTORY. WITHOUT LIMITING THE FOREGOING, ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, AND THE IMPLIED WARRANTY OR CONDITION OF FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY EXCLUDED AND DISCLAIMED. EACH PARTY REPRESENTS AND WARRANTS THAT IT HAS CONSULTED INDEPENDENT LEGAL COUNSEL WITH RESPECT TO THE LEGALITY OF THE ARRANGEMENTS DESCRIBED HEREIN, AND THAT EACH SUCH PARTY HAS MADE AN INDEPENDENT DETERMINATION AS TO THE LEGALITY OF THE ARRANGEMENTS DESCRIBED HEREIN UNDER APPLICABLE STATE AND FEDERAL LAWS.

Limitation of Liability
CLIENT AGREES THAT FREE CONFERENCE SERVICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES , SHAREHOLDERS, AGENTS, LICENSORS AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES OR COSTS INCURRED AS A RESULT OF LOSS OF TIME, LOSS OF SAVINGS, LOSS OF DATA, LOSS OF PROFITS OR LOSS OF GOODWILL, WHETHER FORESEEABLE OR UNFORESEEABLE, THAT MAY ARISE OUT OF OR IN CONNECTION WITH THE AGREEMENT INCLUDING, BUT NOT LIMITED TO DAMAGES OR COSTS RESULTING FROM THE USE OF INABILITY TO USE THE NETWORK OR SERVICES OFFERED THERE UNDER, EVEN IF FREE CONFERENCE SERVICE HAS BEEN NOTIFIED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES OR COSTS INCURRED, AND WHETHER SUCH LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, PRODUCTS LIABILITY OR OTHERWISE.

IN NO EVENT WILL THE AGGREGATE LIABILITY OF FREE CONFERENCE SERVICE FOR ANY DAMAGES INCURRED BY CLIENT EXCEED THE FEES RECEIVED BY FREE CONFERENCE SERVICE UNDER THIS AGREEMENT DURING THE TWELVE (12) MONTHS PRIOR TO THE TIME AT WHICH THE DAMAGES AROSE, REGARDLESS OF THE FORM OF ACTION, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, PRODUCTS LIABILITY OR OTHERWISE.

Right to Use
Subject to the terms and conditions of this Agreement, We grant you only the right to use the Services, in accordance with this Agreement. You receive no rights to, modify, or reproduce, the Services or associated software.

No Commercial Use
Other than using the Services for conferences in which you are an active participant, and as permitted under the terms and conditions of this Agreement or other written agreements between you and Free Conference Service, you may not resell, distribute, make any commercial use of, use on a timeshare service bureau basis, or use to operate a Web-site or otherwise generate income from the Services.

Legal Disclosure
While Free Conference Service Conferencing is dedicated to protecting user privacy and information, we may be required by law or believe in good faith that disclosure is required in the following cases: a. to protect our rights or property or those of our users b. to comply with legal procedures served on us or our affiliates c. in connection with a corporate transaction such as consolidation, merger or sale of assets.

We reserve the right to use your personal information to investigate and aid in preventing potentially unlawful activity or activity that threatens our services, company or clients.

Modification and Severability
We reserve the right to make changes to our site and policies at any time. If any of these conditions are deemed invalid, void, or for any reason unenforceable, that condition well be deemed severable and will not affect the validity and enforceability of any remaining condition.
